development and resolving accompanying conflicts. Each Trust is a legal entity, incorporated by the settlor on behalf of the host communities, with the full representation of the host communities, and managed by the appointed representatives of the host communities.<\/p><p>The beautiful thing about the HCDT (the Trust) is that whatever issues the community wants to address\u00a0<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">can be addressed directly and effectively by the communities. This is done by ensuring adequate\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">representation for the communities on the Board of Trustees, the Management Committee and the\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">Advisory Committee of the HCDT. Whether it is jobs, health, social safety nets, roads, business seed or\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">grants, housing, fishing and agriculture, host communities now have a chance to direct their\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">development. These include the Board of Directors, the Management Committee, and the Advisory\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">Committee.<\/span><\/p><p>The gazetted regulation for the HCDT specifically mandates that settlors submit the proof of the host\u00a0<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">communities meeting during which community representatives were appointed as part of the\u00a0<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">prerequisites for approval in setting up the Trust.<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1469\" class=\"elementor-tab-title\" data-tab=\"9\" role=\"button\" aria-controls=\"elementor-tab-content-1469\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">What are some of the detailed provisions of the law about the Trusts?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1469\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"9\" role=\"region\" aria-labelledby=\"elementor-tab-title-1469\"><p>&nbsp;Section 235 &#8211; Host communities development trust<\/p>\n<ol>\n<li>\u201cThe settlor shall incorporate host communities development trust for the benefit of the host communities for which the settlor is responsible.<\/li>\n<li>\n<p>Where there is a collectivity of settlors operating under a joint operating agreement with&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">other community determined by the settlors shall be host communities for the purpose of this&nbsp;<\/span><span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">Act.<\/span><\/p>\n<\/li>\n<li>\n<p>The settlor shall for the purpose of setting up the trust, in consultation with the host&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">communities, appoint and authorize a board of trustees, which shall apply to be registered by&nbsp;<\/span><span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">the Corporate Affairs Commission as a corporate body under the Companies and Allied Matters&nbsp;<\/span><span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">Act\u2026\u201d<\/span><\/p>\n<\/li>\n<\/ol>\n<p>Subsection 7<\/p>\n<p>\u201cThe settlor shall undertake needs assessment that will metamorphose into the community&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">development plan for the purpose of determining the projects to be undertaken by the host&nbsp;<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">communities development trust.\u201d<\/span><\/p>\n<p>Section 238<\/p>\n<p>\u201c\u2026 <b>failure by any holder <\/b>of a licence or lease\u2026to comply with its obligations under this chapter, after&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">having been informed of such failure in writing by the commission\u2026<\/span><b style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">may be grounds for revocation of&nbsp;<\/b><b style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">the applicable licence or lease<\/b><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">\u201d<\/span><\/p>\n<p>Section 239, Subsection 1<\/p>\n<p>\u201cThe constitution of the host communities development trust shall allow the host communities&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">development trust to manage and supervise the administration of the annual contribution of the settlor&nbsp;<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">contemplated under this chapter and any other sources of funding.\u201d<\/span><\/p>\n<p>Section 239, Subsection 3 (Objectives of the HCDT)<\/p>\n<p>The objectives of the host communities development trust shall include, to \u2013<\/p>\n<ol>\n<li>\n<p>Finance and execute projects for the benefit and sustainable development of the host&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">of the environment;<\/span><\/p>\n<\/li>\n<li>\n<p>Support local initiatives within the host communities which seek to enhance security;<\/p>\n<\/li>\n<li>\n<p>Invest part of available fund for and on behalf of the host communities; and<\/p>\n<\/li>\n<li>\n<p>Assist in any other developmental purpose deemed beneficial to the host communities&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">as may be determined by the Board of Trustees.<\/span><\/p><\/li><\/ol><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14610\" class=\"elementor-tab-title\" data-tab=\"10\" role=\"button\" aria-controls=\"elementor-tab-content-14610\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\"> Host Communities Development Trusts \u2013 Operational Details<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14610\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"10\" role=\"region\" aria-labelledby=\"elementor-tab-title-14610\"><p><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">Section 242 \u2013 Board of Trustees<\/span><br><\/p><p>(2) \u201cThe settlor shall, in consultation with the host communities, determine the membership of the&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">Board of Trustees to include persons of high integrity and professional standing,&nbsp;<\/span><span style=\"font-weight: 700; color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">who shall come from&nbsp;<\/span><span style=\"font-weight: 700; color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">the host communities&nbsp;<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">and the Members of the Board of Trustees shall elect a Chairman from amongst&nbsp;<\/span><span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">themselves.\u201d<\/span><\/p><p>4) \u201cEach member of the Board of Trustees shall&nbsp;<span style=\"font-weight: 700;\">serve a term of four years&nbsp;<\/span>in the first instance and may&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">be reappointed for another term of four years and no more.\u201d<\/span><\/p><p>Section 243 \u2013 Functions of the Board of Trustees<\/p><p>\u201cThe Board of Trustees shall be responsible for the general management of the host communities&nbsp;<span style=\"color: var( --e-global-color-ffcd92b ); font-size: 1rem;\">development trust and shall be responsible for \u2013<\/span><\/p><p>Determining the criteria, process and proportion of the host communities development trust<\/p><ol style=\"font-size: 16px; background-color: rgb(255, 255, 255);\"><li style=\"font-size: 16px;\">fund to be allotted to specific development programs;<\/li><li style=\"font-size: 16px;\"><p>Approving the projects for which the host communities development trust fund shall be utilized;<\/p><\/li><li style=\"font-size: 16px;\"><p>Providing general oversight of the projects for which the host communities development trust&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">fund shall be utilized;<\/span><\/p><\/li><li style=\"font-size: 16px;\"><p>Approving the appointment of fund managers for the purposes of managing the reserve fund;<\/p><\/li><li style=\"font-size: 16px;\"><p>Set up the management committee of the hosting communities development trust and appoint&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">its members; and<\/span><\/p><\/li><li style=\"font-size: 16px;\"><p>Determine the allocation of trust funds to host communities based on the matrix provided by&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">the settlor.<\/span><\/p><\/li><\/ol><p>Section 247 \u2013Management Committee<\/p><ol style=\"font-size: 16px; background-color: rgb(255, 255, 255);\"><li style=\"font-size: 16px;\"><p>The constitution of the host communities development trust shall contain provisions requiring&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">the fund to the Board of Trustees and where any portion of the fund is not utilized in a given&nbsp;<\/span><span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">year, it shall be returned to the capital fund.<\/span><\/p><\/li><\/ol><p>Section 245 \u2013 Fund Distribution Matrix<\/p><ol style=\"font-size: 16px; background-color: rgb(255, 255, 255);\"><li style=\"font-size: 16px;\"><p>\u201cThe settlor shall provide to the Board of Trustees a matrix for distribution of the trust fund to&nbsp;<span style=\"background-color: transparent; color: var( --e-global-color-ffcd92b );\">the host communities.<\/span><\/p><\/li><li style=\"font-size: 16px;\"><p>The Board of Trustees shall utilize the matrix provided\u2026 for distribution of the funds in the host communities development trust fund to each of its host communities.\u201d<\/p><\/li><\/ol><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14614\" class=\"elementor-tab-title\" data-tab=\"14\" role=\"button\" aria-controls=\"elementor-tab-content-14614\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">What is NUPRC\u2019s role in the Trusts and Trust Funds?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14614\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"14\" role=\"region\" aria-labelledby=\"elementor-tab-title-14614\"><p>The overall objective of the commission is to \u201cpromote healthy, safe, efficient and effective conduct of upstream petroleum operations in an environmentally acceptable and sustainable manner\u201d<\/p><p>In furtherance of this objective, the commission regulates and oversees the implementation and operation of the Trusts and Trust Funds.<\/p><p>According to the Act,<\/p><p>\u201cThe commission shall<\/p><ol><li>make regulations on the administration, guide and safeguard the utilization of the trust fund; and<\/li><li>have the oversight responsibility of ensuring that the projects proposed by the Board of Trustees are implemented.\u201d<\/li><\/ol><p>In furtherance of its role, the NUPRC has developed regulations and templates guiding the activities of the Trusts and the Trust funds all of which are available on NUPRC\u2019s website.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14615\" class=\"elementor-tab-title\" data-tab=\"15\" role=\"button\" aria-controls=\"elementor-tab-content-14615\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">How does PIA addresses oil spills and other harmful environmental problems?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14615\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"15\" role=\"region\" aria-labelledby=\"elementor-tab-title-14615\"><p>The PIA introduces strong financial and regulatory deterrents for operators to avoid environmental degradation and respond to environmental and safety accidents promptly and effectively. This is done through the instrumentality of the <strong><b>environmental remediation fund,<\/b><\/strong>\u00a0which is an upfront financial commitment by operators in an account accessible to the commission. It also forbids gas flaring and venting, imposing stiff fines, the proceeds of which serve to address environmental problems in the host communities.<\/p><p>Section 103, subsection 1 of the Act states that \u201cas a condition for the grant of a licence or lease and prior to the approval of the environmental management plan by the commission, a licensee or lessee shall pay a prescribed financial contribution to an environmental remediation fund established by the commission, for the rehabilitation or management of negative environmental impacts with respect to the licence or lease.\u201d<\/p><p>In addition, subsection 4 states that \u201cwhere licensee or lessee fails to rehabilitate or manage or is unable to undertake the rehabilitation or management of any negative impact on the environment, the commission may upon written notice to the holder apply the fund to rehabilitate or manage the negative environmental impact.\u201d<\/p><p>To strictly eliminate gas flaring and venting, the Act requires all natural gas-producing licensees or lessees to submit a natural gas elimination and monetization plan to the commission within 12 months. The Act also prescribes a fine for gas flaring or venting, which fine \u201cshall be for the purpose of environmental remediation and relief of the host communities of the settlors on which the penalties are levied.\u201d \u00a0In addition, such a fine will not be \u201celigible for cost recovery or be tax deductible.\u201d<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14616\" class=\"elementor-tab-title\" data-tab=\"16\" role=\"button\" aria-controls=\"elementor-tab-content-14616\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">How are abandoned wells and other assets handled under the PIA?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14616\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"16\" role=\"region\" aria-labelledby=\"elementor-tab-title-14616\"><p>Where petroleum wells, installations, structures, utilities, plants, and pipelines on land and offshore are decommissioned, such decommissioning must be done under the provisions of the Act, specifically \u201cInstallations and structures on land shall be completely removed and the environment restored to its original condition, except for buried transportation pipelines and gathering lines\u201d, and that must be done \u201cin a manner that guarantees sustainable environmental development\u201d (Section 232)<\/p><p>In addition<\/p><p>\u201cEach lessee and licensee shall set up, maintain and manage a <strong><b>decommissioning and abandonment fund<\/b><\/strong>\u00a0held by a financial institution that is not an affiliate of the lessee or licensee, in the form of an escrow account accessible by the commission.\u201d<\/p><p>\u201cThe decommissioning and abandonment fund shall exclusively be used to pay for decommissioning and abandonment costs.\u201d<\/p><p>Finally, \u201cwhere a lessee or licensee fails to comply with the decommissioning and abandonment plan, the decommissioning and abandonment fund shall be accessed by the commission to pay for the performance by a third part of such lessee\u2019s or licensee\u2019s obligations\u201d (Section 233)<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14617\" class=\"elementor-tab-title\" data-tab=\"17\" role=\"button\" aria-controls=\"elementor-tab-content-14617\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">What are the responsibilities of the Host Communities under the Act?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14617\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"17\" role=\"region\" aria-labelledby=\"elementor-tab-title-14617\"><p>The host communities are required to do the following to gain the maximum benefit from the Act:<\/p><ol><li>Nominate representatives to the three levels of leadership of the HCDT.<\/li><li>Collaborate with their representatives to ensure their needs are surfaced and prioritized.<\/li><li>Monitor the progress of the projects being executed in the communities.<\/li><li>Provide an enabling environment for the execution of community projects, the development of petroleum infrastructure, and the improvement of security.<\/li><\/ol><p>Concerning the last responsibility above, section 257, subsection 2 of the Act states that \u201cwhere in any year, an act of vandalism, sabotage or other civil unrest occur that causes damage to petroleum and designated facilities or disrupts production activities within the host communities, the community shall forfeit its entitlement to the extent of the costs of repairs of the damage that resulted from the activity with respect to the provisions of this Act within that financial year; provided the interruption is not caused by technical or natural cause.\u201d<\/p><p>In other words, the more petroleum investments communities allow, the more the settlor&#8217;s contribution to the HCDTF in the following year. It is also true, that where communities <em><i>don\u2019t allow investments to happen, or you delay or disrupt equipment installation, their actions directly reduces or eliminates the funding for their specific host communities in the following year<\/i><\/em>.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14618\" class=\"elementor-tab-title\" data-tab=\"18\" role=\"button\" aria-controls=\"elementor-tab-content-14618\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">Responsibilities of the community representatives in the HCDT?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14618\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"18\" role=\"region\" aria-labelledby=\"elementor-tab-title-14618\"><p>The representatives of the communities in the HCDT must deal with integrity, transparency, and in the interests of the host communities they represent.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14619\" class=\"elementor-tab-title\" data-tab=\"19\" role=\"button\" aria-controls=\"elementor-tab-content-14619\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">How else does the Act protect host Communities?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14619\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"19\" role=\"region\" aria-labelledby=\"elementor-tab-title-14619\"><p>The PIA forbids damage to protected and venerated objects because of an operator\u2019s activities while protecting private property owners&#8217; rights.<\/p><p>The Act lists areas where operators or licensees cannot take over to include<\/p><ol><li>Sacred lands, defined by a customary court<\/li><li>Public land<\/li><li>Government compounds<\/li><li>Areas in a town, village, market, or cemetery<\/li><li>A building or within 50yards of buildings, water reservoirs, dams, public roads or tramways or 100meter from a railway track<\/li><li>Farmland under active cultivation<\/li><li>Other private property without permission from the commission, and payment of fair and adequate compensation to the person in lawful possession.<\/li><\/ol><p>Operators shall also not &#8211;<\/p><ol><li>Injure or destroy any tree or objects of commercial value or of veneration in the catchment area<\/li><li>Damage or destroy any building or property<\/li><li>Disturb or damage surface of the land or any other rights to any person who owns or is in lawful occupation of the surface area covered by the license.<\/li><\/ol><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14620\" class=\"elementor-tab-title\" data-tab=\"20\" role=\"button\" aria-controls=\"elementor-tab-content-14620\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">What about Fishing Rights?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14620\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"20\" role=\"region\" aria-labelledby=\"elementor-tab-title-14620\"><p>The Nigeria Acreage Management Drilling and Productions Regulations, made pursuant to Part II of the PIA 2021, clearly states that \u201cif the licensee or lessee exercises the rights conferred by his license or lease in such a manner as unreasonably to interfere with the exercise of any fishing rights, he shall pay adequate compensation thereof to any person injured by the exercise of those first-mentioned rights.\u201d<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-14621\" class=\"elementor-tab-title\" data-tab=\"21\" role=\"button\" aria-controls=\"elementor-tab-content-14621\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">Why would the Settlors\/Operators Comply? <\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-14621\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"21\" role=\"region\" aria-labelledby=\"elementor-tab-title-14621\"><p>Firstly, it is the law.<\/p>\n<p>Secondly, specific sections of the Act further link the renewal of leases and licences to the performance of these community and environmental obligations, in addition to the commission\u2019s ability to recommend the revocation of leases and licences.
